Fire Protection Legal Notice

NOTICE FOR PUBLIC HEARING ON

FIRE PROTECTION CONTRACT FOR 2025

            Public Notice is hereby given, that a Public Hearing will be held Wednesday,

November 6th, 2024 by the Town Board of the Town of Batavia, Genesee County, New York, at 7:10 P.M. of that day at the Batavia Town Hall, 3833 West Main Street Road, Batavia, New York, for the purpose of considering contracting with the Town of Batavia Fire Department, Inc. for fire protection services to be furnished by the Town of Batavia Fire Department, Inc to the Fire Department District established in the Town of Batavia and known as the “Town of Batavia Fire Protection District” upon the following general terms, to wit:

  1. The Town of Batavia Fire Department, Inc. shall answer and attend upon all calls in said District;
  2. The Town of Batavia Fire Department Inc., shall purchase and maintain such property, crime, dishonesty bond and liability insurance as it deems prudent to protect its interests.  Such insurance shall include Automobile Liability, General Liability naming the Town of Batavia, its agents and employees as Additional Insureds, Contractual Liability for this Contract and should include Ambulance Attendants Professional Liability, Volunteer Fire Department Errors and Omissions Liability and Liquor Law Liability coverages.  Liability limits of at least $1,000,000.00 each occurrence, claim or incident are recommended but not required.  A Certificate of all liability insurances, providing the Town with at least 30 days written notice of cancellation or nonrenewable, shall be furnished to the Town Attorney, Town Hall, 3833 West Main Street Road, Batavia, New York, 14020.
  3. The Town of Batavia Fire Department, Inc. shall also indemnify and hold harmless the Town of Batavia, its agents and employees from all claims, suits, loss, damages, injuries, liability, cost and expenses arising from the services provided for in this contract and from the activities of the Fire District, its officers, employees and volunteers to the extent this provision is insured by the Town of Batavia Fire District.
  4. The Town of Batavia Fire Department, Inc. shall maintain public liability and property damage insurance policies for the benefit of said District and the Town of Batavia, and shall hold said District and Town harmless for losses not covered by insurance;
  5. The Town of Batavia Fire Department, Inc. shall be responsible for loss or damage sustained in fire apparatus or other equipment;
  6. The Town of Batavia and the Town of Batavia Fire Protection District shall pay or provide insurance coverage for authorized items;
  7. The Town of Batavia Fire Department, Inc. shall participate in the Genesee County Mutual Aid Plan and reserves certain rights pertaining to said participation;
  8. The Town of Batavia Fire Department, Inc. shall reimburse the Town of Batavia should its equipment not be usable;
  9. For such services the Town of Batavia Fire Department shall receive the yearly sum of one million, four hundred sixty-one thousand, nine hundred, twelve dollars, and thirty-eight cents ($1,461,912.38).
  10. The Town of Batavia shall plow and provide routine maintenance to the driveways and parking areas of the Fire Department’s Fire Halls;
  11. The Town of Batavia Fire Department, Inc. shall provide financial data and records to the Town of Batavia.
  12. The contract shall run for one (1) year from January 1, 2025, and shall expire on December 31, 2025.

Notice is hereby further given that all persons interested in the matter will be heard at such time and place specified above, and a copy of the proposed “Town of Batavia Fire Department Agreement”, is on file at the office of the Batavia Town Clerk, 3833 West Main Street Road, Batavia, New York, and is open for inspection during regular Office hours.

Town 2025 Budget Legal Notice

NOTICE OF PUBLIC HEARING ON THE 2025 TOWN BUDGET

PUBLIC NOTICE IS HEREBY GIVEN that the Preliminary Budget of the Town of Batavia for fiscal year 2025 has been completed and filed in the Office of the Town Clerk of the Town of Batavia, where it is available for public inspection during regular business hours.

Notice is also given that the Town Board of the Town of Batavia will hold a Public Hearing on the Preliminary Budget at the Batavia Town Hall, 3833 West Main Street Road, Batavia, New York beginning at 7:15 P.M. on Wednesday, November 6th, 2024, at which time and place any person will be heard in favor of or in opposition to any item or items contained therein.

Deputy Supervisor$20,000.00

Water Rates Legal Notice

NOTICE OF PUBLIC HEARING

WATER RATE – MAY 2025 TO FEBRUARY 2026

PUBLIC NOTICE IS HEREBY GIVEN that a public hearing will be held November 6, 2024 at the Batavia Town Hall, 3833 West Main Street Road, Batavia, New York, at 7:05 P.M. for the purpose of imposing water rates.  The proposed base water rate for May 2025 to February 2026 is $ 6.87/1,000 gallons, representing a 3 % increase from current rate and the proposed Agricultural water rate for May 2025 to February 2026 is $5.57/1,000 gallons, representing a 3 % increase from current rate.

The foregoing by order of the Batavia Town Board.

Sewer Rents Legal Notice

NOTICE OF PUBLIC HEARING

SEWER RENTS – MAY 2025 TO FEBRUARY 2026

PUBLIC NOTICE IS HEREBY GIVEN that a public hearing will be held November 6, 2024, at the Batavia Town Hall, 3833 West Main Street Road, Batavia, New York, at 7:00 P.M. for the purpose of imposing Sewer Rents.  The proposed sewer rents for May 2025 to February 2026 are Sewer District No. 1 at $7.67/1,000 gallons and Sewer District No. 2 at $7.67/1,000 gallons, representing a 3% increase from the current rates.

Planning Board Canceled

The regular meeting of the Town of Batavia Planning Board for Tuesday, October 1st has been cancelled.    We are still waiting for project information.   Our next regular meeting will be Tuesday, October 15th at the Town Hall.

Roadwork

TRAFFIC DELAYS
TO ALL TRAFFIC UTILIZING THE FOLLOWING ROADWAYS


Brown Road – Wilkinson Road to Pembroke Townline
Downey Road – Galloway Road to Batavia-Oakfield Townline Road
Wortendyke Road – Route 33/ Pearl Street Road to Alexander Townline


On August 14, 2024, from 7:00 AM to 5:00 PM, resurfacing operations will occur on the listed roads.
Traffic should expect delays and short-term closures while resurfacing operations occur.
All through traffic should seek alternative routes.
Residents on the listed roads will be permitted access to their property but may experience delays.

Notice of Special Election

NOTICE OF SPECIAL ELECTION
East Pembroke Fire District
in the Towns of Pembroke, Batavia and Alabama
Genesee County, New York


NOTICE IS HEREBY GIVEN that pursuant to a resolution of the Board of Fire Commissioners,
a special election of the qualified voters of the East Pembroke Fire District, New York, County of
Genesee, will be held at the East Pembroke Fire District’s Fire Firehouse located at 8655 Barrett
Dr, Batavia, NY 14020 on the 3
rd day of September, 2024, between the hours of 6 p.m. and 9 pm.
to vote on whether to approve the following resolution adopted by such Board of Fire
Commissioners:


RESOLUTION FOR FINANCING OF A FIRE ENGINE


RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF THE
EAST PEMBROKE FIRE DISTRICT, GENESEE COUNTY, NEW YORK
(THE “DISTRICT”), AUTHORIZING THE FINANCING OF A FIRE
ENGINE; ESTIMATING THE TOTAL COST THEREOF AT A
MAXIMUM OF $1,207,000 PRINCIPAL; APPROPRIATING SAID
AMOUNT THEREFOR; AND AUTHORIZING THE FINANCING BY A
COMBINATION, IN FULL OR IN PART, OF ANY OF THE FOLLOWING:
BY ISSUANCE OF A SERIAL BOND OR STATUTORY INSTALLMENT
BOND OR INSTALLMENT PURCHASE AGREEMENT FOR UP TO
$600,000 UP TO TWENTY (20) YEARS AND TO ISSUE BOND
ANTICIPATION NOTES IN CONJUNCTION WITH THE ABOVE, FOR
UP TO FIVE (5) CONSECUTIVE YEARS, AND TO UTILIZE CAPITAL
RESERVE FUNDS UP TO $700,000.


That pursuant to Local Finance Law Section 80, the validity of such bonds or notes or any bond
anticipation notes issued in anticipation of the sale of such bonds may be contested only if such
obligations are authorized for an object or purpose for which the fire district is not authorized to
expend money; or if the provisions of law which should be complied with as of this date are not
substantially complied with, and an action, suit or proceeding contesting such validity, is
commenced within twenty days after the date of such publication; or such obligations are
authorized in violation of the provisions of the constitution.
All persons registered to vote in the district and residing in the district for at least thirty (30) days
prior to the day of the vote may vote in such special election.
